Before his career as an attorney, for 16 years Mr. Polenberg successfully pursued a business management career, which included his tenure as a regional manager for Cintas Corporation. Mr. Polenberg managed the region by recruiting, training, developing, and producing sales and profit, which provides Mr. Polenberg with insight to the business challenges facing today's companies. Using his business experience, Mr. Polenberg became a lawyer with the prestigious law firm of Weil Gotshal & Manges LLP, and then started his own firm in the summer of 2005, now known as Polenberg Cooper, P.A. As a result, Mr. Polenberg has civil litigation experience in cases involving business torts, class actions, construction, contracts, employment, fraud, insurance coverage, lender liability, and securities litigation. Mr. Polenberg has represented clients in matters before the Securities and Exchange Commission and other regulatory agencies.
With this unique experience in both business and law, Mr. Polenberg has a practical approach to litigating commercial matters for his clients. He has established a consistent record of successful results in state and federal courts and arbitration. Mr. Polenberg has achieved successful outcomes for his clients during the several phases in the litigation process through motions, trials, and appeals. Obtaining favorable results for his clients is a priority while emphasizing the highest professional standards.
Mr. Polenberg recently worked as the central attorney in a False Claims Act litigation brought by a competitor against Applera Corporation in which the plaintiff claimed damages of $6 billion. The team prevailed on its motion to dismiss. He also represented American Airlines in working through the legal challenges presented by the North Terminal development Program at Miami International Airport. Accompanying these high stakes matters, Mr. Polenberg has represented Florida businesses in cases critically important to their continued business operations.
In addition to the civil matters, Mr. Polenberg has devoted his time to pro bono cases dealing with children's legal issues. Working with the not-for-profit organization, Lawyers for Children America, Mr. Polenberg has assisted children who have no legal representation. Notably, Mr. Polenberg represented four siblings whose mother and father were accused of neglect because they forced their children to live on a vegan diet in which the children were not allowed to eat cooked or processed food. The jury convicted the parents, and the Criminal Court sentenced them to probation but did not terminate their parental rights. With others, Mr. Polenberg devised a monitored probation program to ensure the children's health and safety while fulfilling the Dependency Court's requirement to reunite the parents with their children.
Mr. Polenberg is also active in the Florida Bar. He is currently a member of the Business Law Section of the Florida Bar, and a member of the Business Litigation Committee and Legislation Committee as well as a member of the subcommittee on electronic discovery rules for Florida Courts. Most recently, the Florida Bar appointed Mr. Polenberg to the Federal Court Practice Committee, which is a standing committee of the Florida Bar. As stated on the Florida Bar website, this committee serves as the Bar's liaison to the federal courts, the standing committees of the Federal Judicial Conference, and to chapters of the Federal Bar Association in Florida, and those committees of The Florida Bar interested in federal practice.
Mr. Polenberg received a J.D. from the University of Miami School of Law magna cum laude, where he received the Order of the Coif award, graduating fifth in his class. He graduated from Florida Atlantic University where he received a B.B.A., summa cum laude.
